Introduction

N3XPay is a platform that facilitates card issuance and card generation by partnering with fully registered and compliant card providers. N3XPay is not a card issuer and does not directly issue cards. We act solely as an intermediary between users and our card providers.

Acceptance of Terms

By accessing or using N3XPay’s platform, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. Your use of our services signifies your acceptance of these Terms.

Our Role

N3XPay facilitates the flow of cryptocurrency to our card providers, who are responsible for issuing top-ups to cards.

N3XPay does not issue or directly manage cards but acts solely as an intermediary to ensure seamless processing between users and card providers.

N3XPay is not responsible for the operational or compliance decisions made by the card providers.

Fees and Charges

Application and Monthly Fees:

N3XPay charges the following fees for card issuance:

Visa or Mastercard: $10 USD equivalent paid in ETH.

Apple Pay or Google Pay: $25 USD equivalent paid in ETH.

There are no monthly maintenance fees associated with using N3XPay services at this time.

Recharge Fees and Limits:

Users may be subject to transaction fees when recharging their accounts. These fees will be transparently communicated during the recharge process.

Minimum recharge amounts may apply and will be outlined at the time of the transaction.

Real-Time Conversion Disclaimer:

N3XPay uses real-time cryptocurrency-to-USD conversion rates to facilitate transactions.

Users deposit cryptocurrency, such as ETH, into their accounts and issue commands in USD value (e.g., /topup 25 represents $25 USD).

Due to the volatile nature of cryptocurrency markets, the displayed USD value may not always perfectly reflect market conditions at the time of the transaction.

Interest Disclaimer:

Funds topped up through cryptocurrencies or other means do not bear interest. N3XPay is not a bank and does not provide any financial or investment services.

Funds and Withdrawals

Current Withdrawal Policy:

At present, funds deposited into the N3XPay bot cannot be withdrawn and are dedicated solely for topping up and issuing cards.

Users are advised to carefully consider their deposits as they will be restricted for these purposes.

Future Withdrawal Functionality:

N3XPay is actively working on implementing a withdrawal function to allow users to withdraw unused balances.

Additionally, N3XPay plans to enable users to generate the private seed for their N3XPay wallet, providing greater control and flexibility over their funds.

Use of N3XPay Services

Account Limitations:

Currently, there is no limit to the number of cards users can issue.

After the BETA phase, card issuance limits will depend on the amount of $N3X tokens held by the user.

Requests for additional accounts or cards beyond these limits must be justified and are subject to approval by N3XPay.

Ownership and Control:

All cards remain the property of the service provider and must be returned upon request.

N3XPay reserves the right to cancel, revoke, repossess, or restrict the use of any card at its sole discretion.

Transaction Authorization:

N3XPay may decline to authorize or reverse transactions under certain conditions, including but not limited to:

Suspected fraud or misuse of the platform.

Violation of these Terms or applicable laws.

Concerns regarding the user’s creditworthiness.

Security Responsibilities:

Users are responsible for safeguarding their account credentials, card numbers, and security features (e.g., CVV, PIN).

N3XPay is not liable for losses resulting from the failure to secure this information.

Card Cancellation Process

Cancellation and Refunds:

Users may initiate card cancellations by contacting N3XPay support.

Refunds for remaining balances are subject to verification and applicable fees.

Cancellation requests may take time to process, and refunds are issued at the discretion of N3XPay.

Suspension or Termination:

N3XPay reserves the right to suspend or terminate cards immediately and without notice under the following conditions:

Multiple failed attempts to use the card.

nteraction with blacklisted merchants or company types, such as pornography, money services, or other restricted industries.

Regulated Issuance

The issuance of N3XPay cards is managed utilizing the B2B services of fully registered and compliant card providers. These providers ensure operational support and compliance with all applicable laws and regulations. For the security of all parties and to maintain confidentiality, the identities of these card providers are not disclosed publicly. However, N3XPay will disclose such information upon receiving a valid legal request from a recognized authority. This approach ensures transparency while safeguarding the legal and contractual agreements with our partners.

Provider Liability

N3XPay is not liable for the actions, policies, or operational decisions of the card providers. Any disputes or claims related to card usage, operational errors, or compliance issues must be addressed directly with the card providers. N3XPay will assist in facilitating communication but holds no direct responsibility for such matters.

Legal Requests and Compliance

N3XPay complies with applicable laws and regulations. Upon receiving a valid legal request, N3XPay will provide necessary information to the card issuers to ensure compliance with legal obligations. This includes, but is not limited to, information provided by users during the registration or card generation process.

Limitations of Liability

To the maximum extent permitted by law:

N3XPay is not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use our services.

N3XPay does not guarantee uninterrupted or error-free access to the platform.

N3XPay is not responsible for any disputes, losses, or issues arising from the use of cards issued by our third-party card providers.

Data Privacy

Your use of N3XPay is governed by our Privacy Policy, which explains how we collect, use, and protect your data. By using our services, you consent to the practices described in the Privacy Policy.

Changes to the Terms

N3XPay reserves the right to update or modify these Terms at any time without prior notice. The most current version will be available on our website. Continued use of our services after changes to the Terms constitutes acceptance of the updated Terms.

Termination

N3XPay reserves the right to suspend or terminate your access to our services if you violate these Terms, engage in any unlawful activity, or at N3XPay's sole discretion without providing a specific reason.
